Deliveries are made to the address indicated in the delivery note which can only be in the agreed sales area.
In case of damage during transport, the justified protest must be made to the carrier within three days of delivery.
The maximum delivery time is 30 working days from the order, unless otherwise specified to the buyer before placing the order and prior to final validation thereof. In this case, Moranelle will indicate an estimated delivery range. The buyer has the right to cancel his order if delivery has not taken place no later than 7 working days after the delivery date indicated by Moranelle, unless this delay in delivery is due to a case of force majeure within the meaning of the jurisprudence of the French courts. Within 10 working days following the buyer's request to cancel the order, Moranelle will reimburse the buyer.
All products supplied by Moranelle benefit from the legal warranty provided by articles 1641 and following of the Civil Code. In the event of non-compliance of a product sold, it may be returned free of charge to Moranelle who will take it back for a credit note, exchange it or refund it. All claims, exchange or refund requests must be made by email to firstname.lastname@example.org. Exclusion of Warranty: Products modified, repaired, integrated or added by the purchaser or any other person not authorized by the supplier of the product are excluded from warranty. The warranty will not apply to apparent defects. The warranty will not cover products damaged during transport or misuse.
Article L 211-4 of the Consumer Code: The seller is required to deliver a good in conformity with the contract and is liable for defects in conformity existing at the time of delivery. He shall also be liable for defects in conformity resulting from packaging, assembly instructions or installation where the latter has been placed at his expense by the contract or has been carried out under his responsibility.
Article L 211-5 of the Consumer Code: To be in conformity with the contract, the goods must:
1) be fit for the use usually expected of a similar good and, where necessary :
- Correspond to the description given by the seller and possess the qualities that he presented to the buyer in the form of a sample or model
- Present the qualities that a buyer can legitimately expect in view of the public statements made by the seller, the producer or his representative, particularly in advertising or labelling
2) or possess the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the seller's attention and accepted by the latter.
Article L 211-12 of the Consumer Code: The action resulting from a lack of conformity is prescribed by 2 years from the delivery of the good
